1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of instaBatch, operated via Instabatch.net and related applications, APIs, and free utility tools (collectively, the "Service"). By creating an account, connecting a social workspace, purchasing a subscription or credits, or using any downloader, converter, extractor, scheduler, or distribution feature, you agree to be bound by these Terms.

If you use the Service on behalf of an organization, agency, or client, you represent that you have authority to bind that entity. If you do not agree, do not access or use the Service. Our Privacy Policy explains how we handle personal and account data and forms part of your agreement with us.

2. The Service

instaBatch is a server-side automation, distribution, and extraction platform for social media workflows. Depending on your plan and tool access, the Service may include: multi-platform content scheduling and publishing; cross-network distribution; workspace-based account and brand management; unified analytics for connected channels; batch and single-item media downloaders (including posts, stories, carousels, profile media, audio, and thumbnails); file converters and media extractors; premium utilities such as watermark removal and auto-captioning; and related dashboards, presets, and support channels.

Features, platform coverage (including networks such as Instagram, TikTok, YouTube, Snapchat, and others we may add), rate limits, credit costs, and Pack Multiplier allowances are described on our pricing and product pages and may change as third-party platforms evolve. Free tools and paid capabilities may differ in throughput, quality options, and support priority. We may modify, suspend, or discontinue any part of the Service with reasonable notice when practicable.

3. Accounts, Workspaces & Connected Platforms

You must provide accurate registration information and keep credentials secure. You are responsible for all activity under your account, including actions by teammates invited to shared or role-based workspaces. Workspaces may store publishing presets, scheduled posts, uploaded assets intended for distribution, channel groupings, and configuration for connected social accounts.

When you connect a third-party social account, you authorize instaBatch to access and act on that account only as needed to provide the features you enable (for example, scheduling, publishing, analytics, or management). You must use official or permitted connection methods and comply with each platform's terms, API policies, and community guidelines. You may revoke connections at any time from your settings; doing so may disable scheduled jobs and automation for those channels.

You remain solely responsible for content you schedule, distribute, or upload through the Service, and for obtaining any rights, consents, or licenses required from rights holders, clients, or end users.

4. Acceptable Use & Content Responsibility

You may use instaBatch only for lawful purposes and in a manner consistent with these Terms and applicable law. You agree not to: (a) download, archive, publish, or redistribute media you do not have the right to use; (b) circumvent platform access controls, scrape private or non-public content, or attempt to access accounts you do not control; (c) use the Service to harass, spam, deceive, or violate intellectual property, privacy, or publicity rights; (d) reverse engineer, overload, or disrupt our infrastructure or that of third-party platforms; (e) resell or white-label the Service without our written consent except as expressly allowed under your plan; or (f) misuse credits, Pack Multipliers, or free tools to evade plan limits.

Extraction and archiving tools are intended for legitimate uses such as managing your own content, client deliverables with authorization, research where permitted, and personal archives of content you are legally entitled to retain. You are responsible for ensuring each request complies with copyright law, platform rules, and any contractual duties you owe to clients or creators.

5. Media Extraction & Pass-Through Processing

For downloading and archiving workflows, instaBatch uses a pass-through architecture. Our servers process extraction requests and stream resulting media to you. We do not permanently store or hoard downloaded media files on our servers as a lasting archive of your extractions. Transient processing, caching required for delivery, job metadata (such as URLs submitted, timestamps, status, and credit consumption), and optional exports of captions or related metadata may exist only as needed to operate and improve the Service.

Availability, format fidelity, and speed of extractions depend on source platforms, public availability of the content, and third-party rate limits. We do not guarantee uninterrupted access to any specific post, story, profile, or media type. Watermark removal, conversion, captioning, and similar premium utilities process files you submit or extract for that job; output quality and licensing implications remain your responsibility.

6. Billing, Credits & Subscriptions

Paid access may include all-in-one plans (such as Beginner, Influencer, and Ultimate), Pack Multipliers that scale account and scheduling limits, individual tool subscriptions, Pay-As-You-Go premium credits, and optional Premium support. Card and similar payments are processed by Stripe or other payment processors we designate. Where offered, cryptocurrency (including USDC and other supported assets) may be accepted for eligible products such as credit packs and annual upfront subscriptions, subject to the limitations stated at checkout.

Subscriptions renew automatically for the selected monthly or yearly cycle until canceled. You may upgrade, downgrade, or cancel from your billing settings; changes take effect according to your current cycle as described in-product. Pay-As-You-Go credits, where stated as non-expiring, remain available for premium extraction and conversion tools until consumed. Fees are generally non-refundable except where required by law or expressly stated by us. Hitting plan limits may pause or block features until you upgrade, purchase credits, or your allowance resets.

7. Intellectual Property & Third-Party Platforms

instaBatch, including its software, branding, documentation, and design, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business or personal workflows in accordance with these Terms. You retain rights in content you upload for scheduling or distribution, subject to the licenses needed for us to operate the Service.

instaBatch is an independent product and is not affiliated with, endorsed by, or sponsored by Meta, Instagram, TikTok, ByteDance, Google, YouTube, Snap Inc., or any other third-party platform we integrate with or extract from. Platform names and logos appear only for identification. Those platforms may change APIs, policies, or availability without notice; we are not liable for resulting interruptions or feature loss.

8. Disclaimers, Liability & Termination

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scheduling, distribution, analytics, or extraction will be error-free, uninterrupted, or compatible with every platform change.

To the maximum extent allowed by applicable law (including Swedish and EU mandatory consumer protections where they apply), our aggregate liability arising from the Service is limited to the amounts you paid us for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or lost-profit damages, including losses from missed posts, account restrictions imposed by third-party platforms, or reliance on extracted media.

We may suspend or terminate access for breach of these Terms, non-payment, abuse of extraction infrastructure, or legal risk. You may stop using the Service at any time. Provisions that by nature should survive (including ownership, acceptable use, disclaimers, and liability limits) will survive termination. These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules, except where mandatory local law provides otherwise. For questions, contact support@instabatch.net.
